Dreamsyte Website Services Agreement

We’re excited to build your Dreamsyte. This Agreement explains what you can expect from Dreamsyte LLC (“Dreamsyte,” “we,” “us,” or “our”) and what we need from you (“Client” or “you”) to keep your project simple, collaborative, and moving forward.

By checking the box agreeing to these terms and/or completing your purchase, you acknowledge that you have read, understood, and agree to this Website Services Agreement.

1. Your Project

Your project includes the Dreamsyte website package and any optional add-ons selected and paid for at checkout.

The specific number of pages, deliverables, and add-ons included in your purchase are determined by the package shown at checkout.

Unless specifically included in your purchased package, Dreamsyte projects do not include custom web applications, custom databases, customer portals, directories, marketplaces, custom membership or subscription systems, complex automations, or other app-like functionality.

Standard website functionality may include contact forms, email signup forms, booking integrations, payment or checkout links, and compatible third-party embeds or integrations.

Third-party platforms, software, subscriptions, licenses, transaction fees, premium plugins, domains, and similar services are not included unless specifically stated.

If functionality requested after purchase falls outside the purchased package, Dreamsyte may provide a separate quote before performing that work.

2. Client Responsibilities

Great projects require collaboration.

You agree to provide the information, content, images, account access, approvals, feedback, and other materials reasonably needed to complete your project.

You represent that you have the right to use all text, images, logos, trademarks, videos, and other materials you provide to Dreamsyte.

You are responsible for reviewing your website before launch, including names, prices, claims, spelling, contact information, links, policies, and other business information.

You are also responsible for the accuracy and legality of your business claims and website content.

3. Feedback & Project Timing

Our streamlined process depends on timely feedback.

When Dreamsyte sends you a design, revision, or other project deliverable for review, please provide your feedback within 3 calendar days unless we agree otherwise in writing.

Project timelines are estimates, not guaranteed completion dates. Delayed content, access, decisions, approvals, feedback, third-party services, technical issues, or requests outside the original scope may extend the project timeline.

If we do not receive required feedback or materials for 14 consecutive calendar days, we may consider the project inactive and close it.

Payments already made on a project closed because of Client inactivity are non-refundable.

If you would like to restart a closed project later, availability is not guaranteed and a restart or rescheduling fee may apply.

4. Revisions

Your website package includes 3 rounds of revisions.

A revision round is one consolidated set of feedback submitted after reviewing the applicable design or website version.

Revisions are intended to refine the approved project direction. A request for a substantially different concept, new pages, major restructuring, additional functionality, or work outside the original scope is not considered a revision and may require an additional fee.

Additional revisions or work beyond the purchased scope will be quoted separately before we proceed.

5. First Design Promise

We want you to feel confident about the direction of your website.

After Dreamsyte presents the first website design concept, you have 3 calendar days to either:

1. continue with the project and provide your first round of revision feedback; or
2. notify us in writing that you would like to cancel the project.

If you choose to cancel during this window, Dreamsyte will refund amounts paid toward the website project minus a $500 non-refundable strategy, creative direction, and design fee for work already performed.

Once you approve the initial direction, submit revision requests, or the 3-day review period expires without a cancellation request, the project becomes non-refundable.

This First Design Promise applies only to the website design service and does not require Dreamsyte to refund third-party purchases, completed add-on work, transaction fees that cannot be recovered, or other non-refundable costs incurred specifically for your project.

6. Payments

Your total project price is the amount displayed and accepted at checkout.

If you use a third-party financing or installment option offered through the payment processor, your agreement with that provider is separate from this Agreement. Dreamsyte is not responsible for financing approval, financing terms, interest, fees, or decisions made by that provider.

Except for the First Design Promise described above, payments are non-refundable once work has begun.

Failure to use, complete, or launch a purchased service does not create a right to a refund.

Dreamsyte may pause work when an amount owed to Dreamsyte is past due.

7. Hosting & Dreamsyte Care

Clients may use compatible managed WordPress hosting of their own or, when selected, host their website through Dreamsyte.

Dreamsyte-hosted websites are hosted using Kinsta’s managed WordPress hosting infrastructure.

When Dreamsyte Care is selected, the first 6 months are included with your website purchase. After the included period, Dreamsyte Care is $29.99 per month and continues until canceled in accordance with the cancellation terms presented at signup.

Dreamsyte Care includes:

• managed WordPress hosting;
• reasonable email support; and
• one Care Update or website improvement suggestion per month.

A Care Update means one small update to existing website content, such as:

• one text change;
• one image replacement;
• one link or basic information update; or
• a comparable minor content change.

Instead of an edit, Dreamsyte may provide one strategic suggestion, such as recommending a headline or other small website improvement.

Care Updates do not accumulate or roll over from month to month.

Dreamsyte Care does not include new pages, new sections, redesigns, new functionality, custom development, extensive troubleshooting, copywriting projects, or other substantial changes. Those services may be quoted separately.

Dreamsyte may rely on third-party hosting and infrastructure providers. We cannot guarantee uninterrupted or error-free operation of third-party services and are not responsible for outages, interruptions, security incidents, platform changes, or other failures outside Dreamsyte’s reasonable control.

Clients using their own hosting are responsible for their hosting account, fees, backups, security, maintenance, compatibility, and provider relationship unless otherwise agreed in writing.

8. Third-Party Services

Your website may connect with services operated by other companies, including scheduling systems, email marketing platforms, payment processors, ecommerce tools, analytics providers, plugins, social platforms, and other software.

You are responsible for maintaining any required third-party accounts and paying their fees.

Dreamsyte cannot guarantee the continued availability, functionality, compatibility, policies, pricing, or performance of third-party services.

If a third-party provider changes or discontinues its service after your website is built, any work required to replace or reconfigure that integration may be billed separately.

9. Results & Marketing Disclaimer

Dreamsyte designs websites and may provide messaging, marketing, creative, or strategic recommendations intended to support your business.

We do not guarantee any specific business result, including sales, revenue, leads, inquiries, bookings, traffic, search-engine rankings, audience growth, conversion rates, or other financial or marketing outcomes.

Your results depend on many factors outside our control, including your offer, pricing, market, audience, traffic, reputation, sales activity, implementation, competition, economic conditions, and other circumstances.

You remain responsible for your business decisions and results.

10. Website Content, Legal Compliance & Accessibility

Dreamsyte is not a law firm, accounting firm, compliance consultancy, or accessibility-certification service.

Unless specifically included in writing, Dreamsyte does not provide legal, tax, regulatory, privacy, medical, financial, accessibility, or compliance advice.

You are responsible for determining which privacy policies, terms, disclaimers, cookie disclosures, accessibility measures, licenses, regulatory disclosures, or other legal requirements apply to your business and website.

11. Ownership

Upon full payment, you own the final website-specific content and design work created specifically for your project, excluding Dreamsyte’s pre-existing materials, tools, processes, frameworks, licensed assets, software, plugins, fonts, stock assets, templates, and other third-party materials.

Third-party materials remain subject to their respective licenses and terms.

Dreamsyte retains ownership of its underlying methods, systems, know-how, reusable design components, processes, and tools.

Unless you ask us in writing not to, Dreamsyte may display the completed project in our portfolio, website, social media, presentations, and marketing materials as an example of our work.

12. Limitation of Responsibility

Dreamsyte will perform the purchased services professionally and in good faith.

To the fullest extent permitted by applicable law, Dreamsyte will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the project or website.

To the fullest extent permitted by applicable law, Dreamsyte’s total liability arising from the services will not exceed the amount you actually paid Dreamsyte for the specific project giving rise to the claim.

Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited.

13. Events Outside Our Control

Neither party will be responsible for delays caused by events reasonably outside its control, including major internet or hosting outages, third-party platform failures, natural disasters, government actions, widespread service disruptions, illness or emergencies, or similar events.

We will communicate with you and resume affected work as reasonably possible.

14. Ending a Project

Dreamsyte may pause or terminate a project for nonpayment, prolonged inactivity, abusive or threatening behavior, unlawful requests, material breach of this Agreement, or circumstances that make it unreasonable or impossible to continue the work.

If Dreamsyte terminates a project without Client breach and without completing the purchased services, we will provide an appropriate refund for prepaid work not performed.

Termination does not eliminate payment obligations for work already completed or non-refundable costs already incurred.

15. Governing Law

This Agreement is governed by the laws of the state in which Dreamsyte LLC is organized, without regard to conflict-of-law principles.

Before filing a legal claim, both parties agree to make a good-faith effort to resolve the dispute informally.

16. Entire Agreement

This Agreement, together with the package description, checkout selections, and any written scope modifications agreed to by both parties, represents the agreement between Dreamsyte and Client regarding the purchased services.

If additional work is requested, Dreamsyte may provide a written change in scope and price for approval before beginning that work.

Agreement at Checkout

By checking “I agree to the Dreamsyte Website Services Agreement” and completing your purchase, you confirm that:

• you have read and agree to these terms;
• you understand the scope and limitations of the website package you selected;
• you understand the 3-round revision policy and 3-day feedback requirement;
• you understand the First Design Promise and its $500 non-refundable fee;
• you understand that Dreamsyte does not guarantee business, sales, marketing, or financial results; and
• if you select Dreamsyte Care, you understand its included period, recurring price, included services, and cancellation terms.
